Terms of Sale

These Terms of Sale govern all quotations, invoices, and sales by Virginia’s Fencing Professionals LLC operating as Fence-U.

1. B2B sales only

Products are sold for commercial, contractor, institutional, or resale use. Fence-U is not positioned as a homeowner retail storefront.

2. Orders and acceptance

All orders are subject to seller acceptance, supplier availability, and pricing confirmation.

3. Payment terms

Unless otherwise agreed in writing, payment is due prior to shipment. Approved accounts may receive alternative terms.

4. Direct ship fulfillment

Many products ship directly from manufacturers or distribution points to the buyer or project location.

5. FOB shipping point; risk of loss

Title and risk of loss transfer to buyer upon delivery to the carrier. Buyer is responsible for freight claims, transit damage, shortage notations, and timely inspection.

6. Freight claims

Buyer must inspect all shipments at delivery, note visible damage or shortages on the delivery receipt, and file all claims directly with the carrier.

7. Returns

Returns require prior written approval. Custom fabricated items, special orders, and non-stock materials are non-returnable unless otherwise agreed in writing.

8. Warranties

Only manufacturer pass-through warranties apply unless expressly stated otherwise in writing.

9. Limitation of liability

Seller liability is limited to the purchase price of the affected goods. Seller is not liable for consequential damages, delays, labor, removal costs, or lost profits.

10. Governing law

These terms are governed by Virginia law.
